LB320 Is Now In Effect
August 28th, 2021

LB320, my priority bill which was signed into law in May, took effect on Saturday, August 28.

This law contains many small but important changes to protect renters and clarify rights in the landlord-tenant relationship.

  • It protects victims of domestic violence from being evicted as a result of that domestic violence, and allows them the ability to obtain a release from their rental agreement.
  • It allows either party to be granted a continuance in eviction proceedings upon a showing of good cause.
  • It clarifies the manner in which a proper notice of eviction must be served.
  • It requires a notice of eviction to contain the specific statutory reason for the eviction.
  • It requires 24 hours written notice before a landlord may enter a tenant’s unit.
  • It updates portions of the Mobile Home Landlord-Tenant Act to reflect changes in the Residential Landlord-Tenant Act.
  • It requires a report from the Supreme Court with data broken down by county on eviction proceedings.
